CLUB LOTUS TERMS AND CONDITIONS
Last updated: 12/05/2026
These Terms & Conditions (“Terms”) govern your use of www.clublotus.co.uk and any associated sub-domains, member areas, forums, archives and online services (the “Website”), and the supply of goods and services by Club Lotus Ltd.
By accessing the Website, registering for an account, joining the club, placing an order or otherwise using our services, you agree to be bound by these Terms together with our Privacy Policy, Cookie Policy, Disclaimer and Acceptable Use Policy. If you do not accept these Terms, please do not use the Website or our services.
1. About us
Club Lotus Ltd is a private limited company incorporated in England and Wales (Company No. 05212328, VAT No. GB 844 117 342), with its registered office at Signpost House, Ambassador Way, Greens Road, Dereham, Norfolk NR20 3TL.
You can contact us at info@clublotus.co.uk or on +44 (0)1362 694459.
In these Terms, “we”, “us” and “our” refer to Club Lotus Ltd; “you” and “your” refer to the person using the Website or buying our services.
2. Eligibility and accounts
To register an account, take out a membership, place an order or post in our forums you must be at least 18 years of age (or 16 with parental consent in respect of a junior or family membership), and provide information that is accurate, current and complete.
You are responsible for keeping your login details secure and for all activity carried out under your account. You must notify us immediately at info@clublotus.co.uk if you suspect that your account has been used without your authorisation. We may suspend or terminate accounts that breach these Terms or our Acceptable Use Policy.
3. Use of the Website
You may use the Website for your own lawful, personal and non-commercial purposes. You agree not to:
- use the Website in any way that breaches applicable law or regulation;
- access or attempt to access member-only areas or other accounts without authorisation;
- introduce viruses, malware or other malicious code;
- carry out automated harvesting, scraping or bulk extraction of content, including from the forums, classifieds or Heritage Digital Archive;
- attempt to interfere with the proper operation of the Website or to circumvent its security; or
- use the Website in any way that could damage, disable, overburden or impair it.
We may suspend or withdraw all or any part of the Website at any time without notice. We do not guarantee uninterrupted availability.
4. Membership
4.1 Application and acceptance
Your application for Club Lotus membership is an offer, which we may accept or decline at our reasonable discretion. A binding contract is formed when we confirm acceptance by email and your first payment has been successfully taken. Acceptance also signals your agreement to be bound by these Terms and by any rules of the club in force from time to time.
4.2 Membership fees and renewal
Membership fees are published on the Website and may be amended on reasonable notice. Membership is annual and renews on the anniversary of your join date. Where you have provided a recurring payment method, we will attempt to renew your membership automatically and will notify you in advance of the renewal date and amount.
From 01/06/2026, a single flat annual membership fee of £49 applies to all new memberships and renewals, in place of previous tiered fees. Existing members will transition at their next renewal.
4.3 Cancellation and refunds
If you join or renew online and wish to cancel, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to do so within 14 days of the date your membership begins, by writing to info@clublotus.co.uk. If you have already accessed member-only content during the cancellation period, we may deduct a proportionate amount in respect of the period of use before refunding the balance. Outside the statutory cancellation window, membership fees are non-refundable except at our discretion.
4.4 Suspension or termination of membership
We may suspend or terminate your membership for serious or repeated breach of these Terms, our Acceptable Use Policy, or behaviour that brings the club into disrepute, in accordance with the principles of natural justice and any club governance rules in force.
4.5 Member benefits
The benefits of membership — including Club Lotus News, access to the forums, area meetings, events, the Heritage Digital Archive, member discounts and other features — are provided on the basis described on the Website from time to time. We may add, vary or remove individual benefits without giving rise to a right of refund, provided that the overall value of membership is not materially diminished.
5. The Club Shop and other purchases
5.1 Orders
A Club Shop order is an offer to buy. A binding contract is formed only when we send you a despatch confirmation (for physical goods) or a service confirmation (for valuations and other digital services). We reserve the right to decline orders, including where stock is unavailable, where pricing has been displayed in error, or where we suspect fraud.
5.2 Pricing, VAT and payment
Prices on the Website are in pounds sterling and are inclusive of any applicable VAT at the prevailing rate. Delivery charges, where applicable, are shown at checkout before you place your order. We accept the card and payment methods displayed at checkout; payments are processed by Stripe and we do not store full card details on our systems.
If we discover an obvious pricing error after you have placed an order, we will contact you and offer the option of continuing at the correct price or cancelling with a full refund.
5.3 Delivery and risk
We aim to despatch in-stock physical goods within the timeframe shown on the product page. Risk in goods passes to you on delivery. Title passes to you when we have received payment in full.
5.4 Right to cancel — physical goods
You have a statutory right to cancel a purchase of physical goods within 14 days of receipt, without giving a reason, under the Consumer Contracts Regulations 2013. To exercise this right, please contact info@clublotus.co.uk before returning the goods.
Returns must be in resaleable condition and the cost of return is the customer’s responsibility unless the item is faulty or incorrect.
We will refund the price of the goods and the standard outbound delivery cost within 14 days of receipt of the returned goods, using the original payment method.
5.5 Right to cancel — digital and personalised services
For digital downloads, digital services and personalised goods (including bespoke Digital Authenticity & Valuations certificates and print-on-demand workshop manuals), the right to cancel under the Consumer Contracts Regulations does not apply once supply has begun with your express consent, or where the goods are made or personalised to your specification. We will make this clear at the point of order.
5.6 Statutory rights
Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 — including that goods must be of satisfactory quality, fit for purpose and as described, and that digital content and services must conform to the same standards.
6. Events and ticketing
6.1 Tickets
Event tickets — for track days, area meetings, hybrid online events and the annual LOG — are sold subject to these Terms and to any specific event terms displayed at the point of sale or attached to your booking confirmation (for example, circuit terms, noise limits, signing-on requirements and any health declarations).
6.2 Refunds and transfers
Unless the event listing expressly states otherwise, event tickets are non-refundable but transferable in accordance with the procedure described on the Website. The statutory 14-day cancellation right does not apply to ticket purchases for events on specified dates (Schedule 1 of the Consumer Contracts Regulations 2013).
6.3 Cancellation by Club Lotus
If we cancel an event, we will offer a full refund of the ticket price or, where reasonable, a transfer to a replacement event. We will not be liable for incidental costs (such as travel, accommodation or fuel) save where required by law.
6.4 Conduct at events
You must comply with the rules of the venue and with instructions given by event officials. We reserve the right to remove from an event, without refund, any person whose conduct presents a safety risk or who is in serious breach of the rules.
6.5 Hybrid events
Hybrid events combine in-person attendance with online sessions. Online sessions may be recorded for later archive use; we will tell you in advance if recording will take place and how the recording will be used.
7. Digital Authenticity & Valuations service
The Digital Authenticity & Valuations certificate is a paid, transferable service provided under its own service terms displayed at the point of purchase. In summary:
- the certificate represents Club Lotus’s considered view based on the information and evidence available to us at the date of issue;
- it is not a guarantee of value, authenticity or fitness for any particular purpose, and does not replace mechanical inspection, a professional engineer’s report, or independent legal due diligence on title;
- certificates are bound to a specific vehicle and may be transferred with the vehicle on change of ownership;
- we may decline to issue a certificate where the available evidence does not allow a reasonable judgement to be reached.
To the extent permitted by law, our liability in respect of the service is limited as set out in section 12.
8. The Heritage Digital Archive
Access to the Heritage Digital Archive is provided as a member benefit and may also be offered under separate digital archive subscriptions from time to time. Use of archive material is permitted for personal, non-commercial research and enjoyment only.
You may not, without our prior written consent: republish archive material in print or online; use it in any commercial product or advertisement; build a derivative database; or apply automated extraction techniques to it.
The archive includes material in which third parties may hold copyright or other rights. Our notice-and-takedown procedure is set out in the Disclaimer; please report any rights concerns to archive@clublotus.co.uk.
9. Forums and user-generated content
The Website contains interactive features — forums, comments, classified advertisements, Lotus Spotted submissions, magazine contributions and similar — through which you may post or upload content (“User Content”).
By submitting User Content you:
- represent that you own the content or have all necessary rights and permissions to submit it;
- grant Club Lotus a non-exclusive, perpetual, royalty-free, worldwide licence to host, store, display, reproduce, edit (for length and clarity), adapt for accessibility and publish your User Content as part of the Website, our magazine and our archive;
- agree to abide by our Acceptable Use Policy; and
- accept that we may remove, edit or restrict access to any User Content at our reasonable discretion.
User Content expresses the views of its author and not those of Club Lotus, its officers or its committee.
10. Intellectual property
All editorial content, design, code, photography, illustrations, audio, structured data and other material on the Website are, unless otherwise indicated, owned by Club Lotus Ltd or used under licence. They are protected by copyright, database right, trade mark and other intellectual property laws.
You may view, download and print pages from the Website for your own personal, non-commercial use only. Any other use — including systematic copying, reproduction, republication, broadcast, transmission, modification or distribution — requires our prior written permission, save as permitted by mandatory provisions of law (including the right to quote for criticism, review or reporting current events under the Copyright, Designs and Patents Act 1988).
Lotus, the Lotus roundel, Esprit, Elise, Elan, Europa, Exige, Evora, Emira, Eletre, Team Lotus and other model and racing identifiers are trade marks of their respective proprietors. Club Lotus Ltd is an independent enthusiast organisation and is not affiliated with, owned by, or endorsed by Group Lotus plc, Lotus Cars Limited or Classic Team Lotus.
11. Third-party links and services
The Website contains links to and integrations with third-party sites and services, including our payment provider, video host, vehicle data providers and external sponsors. These links are provided for your convenience. We have no control over the content or commercial practices of third-party sites and accept no responsibility for them. Your use of any third-party service is subject to that party’s own terms and conditions.
12. Our liability to you
Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any breach of your statutory rights under the Consumer Rights Act 2015; or
- any other liability which cannot lawfully be excluded or limited.
Subject to that, and to the fullest extent permitted by law:
- we are not liable for any loss or damage that is not foreseeable, or that arises from your failure to comply with these Terms;
- we are not liable for indirect, special or consequential loss, loss of profit, loss of business, loss of opportunity, loss of data or wasted expenditure;
- our total aggregate liability to you arising from or in connection with the Website, your membership and any goods or services supplied in any 12-month period is limited to the greater of (a) £250 and (b) the total amount paid by you to Club Lotus Ltd in that period;
- we provide the Website, the forums and the Heritage Digital Archive on an “as is” and “as available” basis and make no warranties of accuracy, completeness, availability or fitness for any particular purpose; and
- you remain responsible for any decisions you take in reliance on information published on the Website — see also the Disclaimer.
13. Events outside our reasonable control
We are not liable for any failure or delay in performing our obligations under these Terms which is caused by an event outside our reasonable control — including industrial action, civil unrest, fire, flood, severe weather, pandemic, failure of public or private telecommunications networks, the acts or omissions of governments or regulators, and the cancellation of access to a third-party venue or service.
14. Changes to these Terms
We may amend these Terms from time to time. The “Last updated” date at the top of the page shows the date of the most recent revision. Where changes are material — for example, to membership fees, refund rules or liability — we will draw them to your attention through the Website and, where appropriate, by email. Your continued use of the Website or our services after a change has been notified constitutes acceptance of the revised Terms.
15. General
15.1 Entire agreement
These Terms, together with the policies they incorporate, constitute the entire agreement between you and Club Lotus Ltd in respect of the Website and our services.
15.2 No waiver
A failure or delay by us in enforcing any provision of these Terms is not a waiver of our right to do so later.
15.3 Severability
If any provision of these Terms is found to be unenforceable, the remainder will continue in full force and effect.
15.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations on reasonable notice, provided that this does not adversely affect your rights as a consumer.
15.5 Third-party rights
A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of their provisions.
15.6 Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
15.7 Complaints and dispute resolution
If you are unhappy with any aspect of our service, please contact us at info@clublotus.co.uk in the first instance so that we can try to resolve the matter. If we cannot resolve it, you may also be entitled to use an Alternative Dispute Resolution scheme; we will let you know if one is available in your case.
